The Downloadable Software
The TakeoutFixer software application that you download operates entirely offline on your computer. It does not collect or transmit any of your personal data, photos, videos, or any other media over the internet. The application may connect to the internet only if you click on informational links within its user interface (such as "About" or "Terms" or "Help") that direct you back to the TakeoutFixer.com website.
Intellectual Property
The Software and its original content, features, and functionality are and will remain the exclusive property of TakeoutFixer.com and its licensors.
Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU.
Limitation of Liability

THIS INCLUDES, BUT IS NOT LIMITED TO, DATA LOSS, DATA CORRUPTION, OR ANY OTHER DIRECT OR INDIRECT DAMAGES.
It is strongly recommended that you back up your data and/or operate on a copy of your files before using the Software.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. By using this Software, you agree to submit to the exclusive jurisdiction of the courts located in Pune, India, to resolve any legal matter arising from the Terms.
Indemnification
You agree to indemnify, defend, and hold harmless TakeoutFixer creator and licensor, its affiliates, agents, and its third party providers from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with any of the following:
- (a) Your access to, use of, or misuse of the TakeoutFixer Application or its website;
- (b) Your violation of these Terms and Conditions;
- (c) Your violation of any applicable laws or regulations;
- (d) Your violation of the rights of any third party, including but not limited to intellectual property rights.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
